The Role of Law in Cybersecurity & Data Protection

In an increasingly digitalized world, cybersecurity and data protection have become fundamental to ensuring trust, privacy, and the integrity of digital infrastructures. As cyber threats grow in complexity and data-driven technologies continue to evolve, legal frameworks play a crucial role in establishing safeguards, defining responsibilities, and ensuring accountability.

Laws and regulations provide the foundation for securing networks, protecting personal data, and balancing security with fundamental rights such as privacy and freedom of expression. However, rapid technological advancements and emerging threats present ongoing challenges for policymakers and legal professionals.

The Amsterdam Law Forum offers a platform for legal scholars, practitioners, and students to critically engage with these evolving issues. We welcome contributions that analyze case law, policy developments, ethical dilemmas, and regulatory frameworks shaping the future of Cybersecurity & Data Protection.

    The Markets in Crypto-Assets (MiCA) Regulation, which was adopted by the EU in 2023 aims to establish a unified legal framework for cryptocurrencies and enhance investor protection. By setting rules for crypto-assets, licensing requirements, and stricter regulations on stablecoins, MiCA improves market transparency and stability. However, it leaves gaps in areas like DeFi and NFTs, and compliance costs may burden smaller firms. This blog explores the legal   landscape of cryptocurrencies in the EU, the key provisions of MiCA, and its implications for innovation, fraud prevention, and financial stability.

  • The EU Screening Regulation and the Fight for Digital Privacy at the Border

    The increasing reliance on smartphones as digital archives at European borders poses severe fundamental rights challenges. The upcoming EU Screening Regulation compels Member States to conduct security checks that may involve digital data extraction. This article examines whether these practices can be reconciled with the privacy standards established by the Court of Justice of the European Union in the judgements Prokuratuur and Landeck. The article argues that reliance on outdated analogue frameworks or the legal fiction of asylum seekers’ consent is untenable. The lawful implementation of the Screening Regulation requires robust national legislation that guarantees prior independent review to protect migrants’ digital privacy. Continue reading!
