Vivian Bij de Vaate onderzoekt het arbeidsrecht in de volle breedte, met bijzondere aandacht voor het ontslagrecht en voor de vraag hoe arbeidsrechtelijke normen in de praktijk worden gehandhaafd en werknemers hun rechten daadwerkelijk kunnen uitoefenen. Haar onderzoek verbindt vragen over de inhoud van arbeidsrechtelijke bescherming met vragen over de mogelijkheden om die bescherming daadwerkelijk te effectueren.
Een belangrijke onderzoekslijn betreft het ontslag(proces)recht. Zij onderzoekt onder meer de inrichting en werking van ontslagprocedures, de rol van de rechter, bewijs en rechtsmiddelen en de rechtsbescherming van werknemers en werkgevers. Haar onderzoek naar het ontslagprocesrecht, dat zijn oorsprong vindt in haar proefschrift Bijzonder ontslagprocesrecht, heeft zich ontwikkeld tot een bredere bestudering van het functioneren van het ontslag(proces)recht in de praktijk. Daarbij besteedt zij ook aandacht aan recente ontwikkelingen, zoals de gevolgen van flexibilisering van arbeidsrelaties en veranderingen in de wettelijke systematiek van het ontslagrecht.
Een tweede, doorlopende onderzoekslijn betreft de handhaving en rechtsbescherming binnen het arbeidsrecht. Centraal staat de vraag hoe arbeidsrechtelijke normen effectief kunnen worden gehandhaafd en welke rol werknemers, vakbonden en andere organisaties daarbij kunnen spelen. Zij onderzoekt in het bijzonder de mogelijkheden en grenzen van collectieve handhaving en collectieve rechtsbescherming, waaronder collectieve acties van vakbonden. Daarbij kijkt zij ook naar de verhouding tussen individuele rechtsbescherming, collectieve handhaving en publiek toezicht.

Vivian Bij de Vaate conducts research across the field of labour law, with a particular focus on dismissal law and on how labour law standards are enforced in practice and workers are able to effectively exercise their rights. Her research connects questions about the substance of labour law protection with questions about how that protection can be effectively enforced.
One of her main research areas is dismissal law and dismissal procedure. She studies, among other things, the design and functioning of dismissal procedures, the role of the courts, evidence and legal remedies, and the legal protection of employees and employers. Her research on dismissal procedure, which originated in her PhD thesis Bijzonder ontslagprocesrecht, has developed into a broader examination of how dismissal law and dismissal procedures operate in practice. This includes attention to recent developments, such as the impact of increasingly flexible employment relationships and changes in the statutory framework governing dismissal law.
A second, continuing line of research concerns the enforcement of and access to legal protection in labour law. At its core is the question of how labour law standards can be effectively enforced and what role employees, trade unions and other organisations can play in this process. She focuses in particular on the possibilities and limits of collective enforcement and collective legal protection, including collective actions brought by trade unions. Her research also examines the relationship between individual legal protection, collective enforcement and public enforcement.
